This presentation will emphasize the importance of thoughtful investigations when complaints of harassment or discrimination are made by an employee through an analysis of the recent discrimination lawsuit against SHRM in which an employee was awarded over $11 million by a jury. The session will provide a deep-dive into risk mitigation best practices, real-world scenarios that may not appear to be clear-cut discrimination complaints but ultimately should be treated as such, and tips for communication between HR, C-suite or ownership, and the company’s attorney. In addition, the session will address the current status of the EEOC’s discrimination guidance and the impact of the U.S. Supreme Court’s Ames decision in so-called “reverse discrimination” cases.
